Kitty AI Studio and all Druid Cat services are intended exclusively for users who are 18 years of age or older.

  • By creating an account, you confirm that you are at least 18 years old
  • This platform is not suitable for minors
  • Parents and guardians are responsible for preventing minors from accessing our services
  • Accounts of users found to be under 18 will be permanently banned without refund
  • Age verification is required during registration

If you are under 18 years of age, you must not use our services.

1. Service Overview

Druid Cat provides AI-powered creative tools and services including:

  • Kitty AI Studio: Browser-based AI image and video generation platform with 60+ workflows including:
    • Nano Banana Pro + Imagen 4
    • Veo 3.1 AI Video Generation
    • WAN 2.7 Text/Image/Reference to Video
    • Qwen Text to Image, Image Editing, Relighting
    • SVI Pro WAN 2.2 Extended Video (up to 30 seconds)
    • Video Enhancement, Upscaling, Frame Interpolation
  • ComfyUI Workflow Packs: AI influencer creation tools available on Gumroad and Patreon
  • Digital Products: Scripts, workflows, and educational content
  • Physical Merchandise: Poker cards, prints, and collectibles
  • Community Services: Patreon membership and exclusive content

2. Subscription Plans & Pricing

Kitty AI Studio (Pay-Per-Use)

Image Workflows

  • Pay per generation based on batch size
  • Pricing from $0.18 per image
  • Batch discounts for multiple images
  • 60+ image generation workflows

Video Workflows

  • Pay per video based on duration
  • Pricing from $0.22 per 5-second video
  • Extended videos up to 30 seconds
  • Video enhancement and upscaling

Cloud Processing

  • All processing on secure cloud GPUs
  • No software installation required
  • Results delivered via secure URLs
  • Files available for 30 minutes after generation

Payment Terms

  • Payment Processing: All payments processed securely via Stripe
  • VAT/Tax: Applied based on your location and local regulations
  • Billing Cycle: Monthly subscriptions renew automatically
  • Currency: Prices displayed in USD unless otherwise specified
  • Cancellation: Cancel anytime - service continues until period end

Account Balance Terms (Kitty AI Studio)

  • Balance Validity: Funds added to your account are valid for 12 months (1 year) from the date of purchase
  • Expiration: Unused balance will expire after 12 months and cannot be recovered
  • Inactive Accounts: Accounts that remain inactive for more than 12 months may be subject to deletion
  • Account Deletion: When an inactive account is deleted, all remaining balance and data will be permanently lost
  • Failed Generations: If a generation fails due to a system error (not user error), the cost will be automatically refunded to your balance
  • No Cash Refunds: Account balance cannot be converted back to cash or transferred to another account
  • Minimum Top-Up: Minimum balance top-up is $5.00 USD

3. User Responsibilities

Acceptable Use

  • Permitted: Creative projects, educational purposes, personal enjoyment
  • Prohibited: Illegal activities, harassment, spam, copyright infringement, malicious use
  • Content Guidelines: Do not generate content that promotes hate, violence, or illegal activities

Account Suspension & Termination

We reserve the right to suspend or terminate accounts that:

  • Violate these terms and conditions
  • Engage in fraudulent activity
  • Abuse our services or attempt to exploit system vulnerabilities
  • Generate prohibited content (illegal, harmful, or exploitative)

Zero Tolerance — Illegal Content

Accounts found generating illegal content — including but not limited to child sexual abuse material (CSAM), terrorism promotion, fraud material, non-consensual intimate imagery, or any other content that violates applicable laws — will be:

  • Permanently banned without prior warning
  • All remaining balance forfeited — no refund
  • Reported to law enforcement authorities in the relevant jurisdiction
  • All account data may be preserved and provided to authorities upon legal request

Inactive Account Policy

Accounts that have been inactive for more than 12 consecutive months (no login, no generation, no activity) will be flagged for deletion.

  • You will receive email notification 30 days before scheduled deletion
  • Simply logging in will reset the inactivity timer
  • Upon account deletion, all remaining balance will be forfeited
  • Deleted accounts cannot be recovered

4. Refund & Cancellation Policy

Subscription Cancellations

  • Cancel Anytime: No questions asked cancellation
  • Service Continuation: Access continues until current period ends
  • No Partial Refunds: Unused portion of subscription not refundable
  • Reactivation: Can reactivate subscription at any time

5. Intellectual Property

Our IP Rights

  • Druid Cat Brand: Trademarks, logos, and branding protected
  • Software: Kitty AI Studio software and ComfyUI scripts proprietary
  • Source Code: The source code of the Kitty AI Studio desktop application, Kitty AI Studio web platform, WordPress plugins, server-side handlers, and all related software components is the exclusive intellectual property of Druid Cat. Unauthorized copying, decompilation, reverse engineering, redistribution, or derivative use of the source code is strictly prohibited.
  • Website Content: Text, images, and design elements copyrighted
  • Training Data: AI models trained on licensed and public domain content

User-Generated Content

  • Your Content: You retain rights to content you create
  • Service License: You grant us license to process and deliver your content
  • Public Sharing: Content you share publicly may be used for promotional purposes

6. Service Availability & Limitations

Service Uptime

  • Target Uptime: 99.9% availability
  • Maintenance: Scheduled maintenance with advance notice
  • Force Majeure: Not liable for outages due to circumstances beyond our control

Usage Limits

  • Generation Limits: As specified in your subscription plan
  • Rate Limiting: Reasonable use policies to ensure service quality
  • Storage Limits: Generated files stored for limited time

7. Third-Party Technology & Licensing

Service Architecture

Druid Cat operates as a technology platform that provides access to AI generation capabilities. The underlying AI models and technology are developed and maintained by third parties; Druid Cat provides the user-facing interface and reliable access to these capabilities.

Third-Party AI Services

Certain features rely on third-party AI providers and models. Your use of these features is subject to the applicable terms of the relevant third-party providers, in addition to these Terms & Conditions:

  • Third-Party Terms: By using AI features through our services, you agree to comply with the applicable acceptable-use policies and terms of service of the underlying third-party AI providers.
  • Open-Source Model Licensing: Where features use open-source models, those models are used under their respective licenses (for example Apache 2.0, MIT, or CreativeML Open RAIL-M). You are responsible for understanding and complying with the applicable model licenses for your particular use case.
  • No Ownership Claims: Druid Cat does not claim ownership of the underlying third-party or open-source models. We provide the interface and access, not the underlying models.

Intermediary Disclosure

Druid Cat acts as a technology intermediary. The underlying AI technology is developed and maintained by third parties. Druid Cat's role is to provide an accessible, user-friendly interface and reliable access to these AI capabilities. We are not responsible for the design, behaviour, or availability of third-party models or infrastructure.

8. AI-Generated Content Disclaimer

Important Notice Regarding AI-Generated Content

Content Responsibility

  • User Responsibility: Users are solely and entirely responsible for all content they generate, request, upload, or distribute using our services. This includes responsibility for ensuring generated content complies with all applicable laws in the user's jurisdiction.
  • Input Rights & Consent: You warrant that you hold all necessary rights, licences, and consents for every prompt and file you upload — including, where you upload the image, likeness, or voice of an identifiable person, that person's consent — and that you have a lawful basis to upload any personal data of others. You must not upload special-category personal data or another person's data without a lawful basis.
  • No Endorsement: Druid Cat does not endorse, verify, or take responsibility for the accuracy, legality, or appropriateness of any AI-generated content.
  • Output Variability: AI models produce outputs based on probabilistic algorithms developed by third-party providers. Results may vary and may not always meet user expectations. Druid Cat has no control over model behavior.
  • No Guarantee: We do not guarantee that AI-generated content will be accurate, original, unique, suitable for any particular purpose, free from errors, or legally compliant in any jurisdiction. AI outputs may resemble existing works or real persons, and we do not warrant that outputs are free from third-party intellectual-property rights or that any copyright subsists in them. You are responsible for reviewing and verifying outputs before use.
  • Model Provider Responsibility: The underlying AI models are developed, trained, and maintained by third-party providers. Any inherent biases, limitations, or issues in model outputs are the responsibility of the respective model providers, not Druid Cat.

Prohibited Content

Users must not use our services to generate content that:

  • Depicts minors in any inappropriate context
  • Constitutes non-consensual intimate, sexualised, or nude imagery of real, identifiable persons
  • Impersonates a real person, or creates deepfakes for fraud, deception, defamation, or disinformation
  • Is used for biometric identification, surveillance, or profiling of individuals
  • Constitutes or promotes illegal activities
  • Infringes on third-party intellectual property rights
  • Contains defamatory, harassing, or threatening material
  • Violates the terms of service of underlying AI providers
  • Could be used for fraud, deception, or malicious purposes

Indemnification

Users agree to indemnify, defend, and hold harmless Druid Cat, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Content generated using our services
  • Violation of these Terms & Conditions
  • Violation of any third-party rights
  • Any illegal or unauthorized use of our services

AI Transparency & Labelling (EU AI Act)

  • AI-Generated Output: All content produced through our services is generated or manipulated using artificial intelligence, and is presented as such in the service interface.
  • Machine-Readable Marking: Outputs produced by AI models operated on our own infrastructure are embedded with machine-readable provenance metadata (IPTC Digital Source Type: trainedAlgorithmicMedia) identifying them as artificially generated. For outputs produced by third-party AI model providers, machine-readable marking (such as embedded provenance metadata or invisible watermarking) is applied by the respective model provider, where supported by that provider. In each case, marking is provided to the extent technically feasible, taking into account the type of content, the limitations of the applicable formats, and the state of the art, in line with Article 50(2) of Regulation (EU) 2024/1689 (the EU AI Act).
  • Do Not Remove Provenance Marking: You must not remove, alter, or strip machine-readable provenance metadata or watermarking from generated content for the purpose of concealing its artificial origin.
  • Your Disclosure Duty When Publishing: If you publish, share, or distribute AI-generated or AI-manipulated image, audio, or video content — in particular content resembling real persons, places, or events ("deepfakes") — you are responsible, as the deploying party, for disclosing that the content has been artificially generated or manipulated, as required by Article 50 of the EU AI Act (Regulation (EU) 2024/1689, applicable from 2 August 2026) and any other applicable law.
  • Interacting with AI: Where our services include an AI chatbot or assistant, you are hereby informed that you are interacting with an AI system.

9. Limitation of Liability

Important: Our services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, Druid Cat expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability and fitness for a particular purpose
  • Warranties regarding the accuracy, reliability, or completeness of AI-generated outputs
  • Warranties that services will be uninterrupted, secure, or error-free
  • Warranties regarding third-party services, APIs, or infrastructure

What We're Not Liable For

  • Content Quality: AI-generated content may not always meet expectations
  • Commercial Success: No guarantee of commercial success using our tools
  • Third-Party Services: Issues with external platforms, API providers, or infrastructure partners
  • Data Loss: Always backup important generated content
  • Indirect Damages: Lost profits, business interruption, loss of data, or consequential damages
  • AI Model Behavior: Unexpected or undesirable outputs from AI models
  • Service Interruptions: Downtime caused by third-party providers or circumstances beyond our control

Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRUID CAT'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO DRUID CAT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100 USD).

Mandatory Consumer Rights (Savings Clause)

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. In particular, we do not exclude or limit liability for:

  • death or personal injury caused by our negligence;
  • intentional misconduct (wina umyślna), gross negligence, or fraud;
  • your mandatory statutory rights as a consumer, including conformity rights for digital content and services under the Polish Ustawa o prawach konsumenta implementing Directive (EU) 2019/770;
  • liability that cannot be limited under the EU Product Liability Directive (Directive (EU) 2024/2853), including death, personal injury, and certain loss or corruption of data.

The limitations and exclusions in this section apply only to the extent permitted by applicable law. If any limitation is found to be invalid as against a consumer, it shall be reduced to the minimum extent necessary, and the remainder of these Terms shall continue in full force and effect.

When using external platforms, their terms and conditions also apply. We are not responsible for changes to third-party services or their terms.

11. Governing Law & Disputes

Applicable Law

  • Jurisdiction: These terms governed by laws of Poland
  • Consumer Protection: If you are a consumer, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law, or of the right to bring proceedings before the courts, of your country of residence in the European Union.
  • EU Rights: EU consumer rights apply where applicable
  • GDPR & AI Act: We comply with the EU General Data Protection Regulation and apply the transparency obligations of the EU AI Act (Regulation (EU) 2024/1689) applicable to our services

Dispute Resolution

  • First Step: Contact us directly to resolve issues
  • Mediation: Attempt mediation before legal proceedings
  • Consumer Rights: EU consumers retain right to local consumer protection

12. Desktop Application & Third-Party API Keys

Kitty AI Studio Desktop App

The Kitty AI Studio desktop application is an optional client that connects to our cloud services. The desktop app may also integrate with third-party services using API keys provided by the user.

Third-Party API Keys

When you provide your own API keys for third-party services (such as ElevenLabs, or any other integrated provider) within the Kitty AI Studio desktop application:

  • Your Responsibility: You are solely responsible for managing your API keys, understanding the pricing and terms of the third-party provider, and monitoring usage and charges on your third-party accounts.
  • No Liability: Druid Cat is not responsible for any charges, fees, data processing, data loss, service interruptions, or other issues arising from your use of third-party API keys.
  • Security: API keys are stored locally on your device and are not transmitted to Druid Cat servers. You are responsible for securing your device and API keys.
  • Third-Party Terms: Your use of third-party services through their API keys is governed by the respective provider's terms of service, not by these Terms & Conditions.

13. Changes to Terms

  • Advance Notice: 30 days notice for material changes
  • Email Notification: Important changes sent to registered email
  • Website Notice: Prominent display of changes on website
  • Continued Use: Using services after changes constitutes acceptance

  • Newsletter Subscription: You consent to be subscribed to our newsletter and to receive periodic emails about new features, product updates, platform improvements, and news related to Kitty AI Studio and other Druid Cat services.
  • Promotional Communications: You consent to receive occasional promotional emails about special offers, new workflows, tutorials, and community updates.

Communication Frequency & Content

  • We aim to send newsletters no more than 2-4 times per month
  • Service-critical notifications will be sent as needed
  • Communications may include information about new AI workflows, feature announcements, maintenance schedules, and community highlights

Your Rights Regarding Communications

  • Unsubscribe: You may unsubscribe from marketing and newsletter emails at any time by clicking the "Unsubscribe" link included in every email
  • Essential Communications: Even after unsubscribing from marketing emails, you will continue to receive essential service communications (account security, payment confirmations, terms updates) as these are necessary for the provision of our services
  • Preferences: You may contact us at any time to update your communication preferences

Legal Basis (GDPR)

For users in the European Union, our legal basis for processing your email address for marketing purposes is your consent, which you provide by accepting these Terms & Conditions. You have the right to withdraw this consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
