Account Suspension & Termination

• Engage in fraudulent activity
• Abuse our services or attempt to exploit system vulnerabilities
• Generate prohibited content (illegal, harmful, or explicit without consent)

4. Refund & Cancellation Policy

• Service Continuation: Access continues until current period ends
• No Partial Refunds: Unused portion of subscription not refundable
• Reactivation: Can reactivate subscription at any time

5. Intellectual Property

• Service License: You grant us license to process and deliver your content

6. Service Availability & Limitations

• Target Uptime: 99.9% availability

• Force Majeure: Not liable for outages due to circumstances beyond our control

7. Third-Party Service Providers & Licensing

Closed-Source / Proprietary AI Services

For certain AI workflows, Druid Cat acts as an authorized reseller and integration partner for third-party API providers. These services are subject to the respective provider's terms of service:

• Google Cloud & DeepMind Services: Imagen, Veo, and related AI generation services are provided through Google Cloud Platform APIs. Usage is subject to Google Cloud Terms of Service and Google Generative AI Terms.
• Alibaba Cloud Services: Qwen and related AI models are provided through Alibaba Cloud APIs. Usage is subject to Alibaba Cloud Terms of Service.
• Other API Providers: Additional AI services may be provided through partnerships with other API providers, each subject to their respective terms of service.

By using these services through Kitty AI Studio, you agree to comply with the applicable third-party terms of service in addition to these Terms & Conditions.

Open-Source AI Models & GPU Cloud Services

For open-source AI workflows (including but not limited to WAN, Flux, SDXL, and ComfyUI-based workflows), Druid Cat operates as a cloud computing service provider:

• Service Model: Druid Cat provides GPU cloud computing infrastructure that executes open-source AI models on behalf of users.
• Model Licensing: Open-source AI models are used under their respective licenses (Apache 2.0, MIT, CreativeML Open RAIL-M, etc.). Users are responsible for understanding and complying with applicable model licenses for their use case.
• No Ownership Claims: Druid Cat does not claim ownership of the underlying open-source models. We provide the technical infrastructure and user interface to facilitate access to these models.

8. AI-Generated Content Disclaimer

Content Responsibility

• User Responsibility: Users are solely responsible for all content they generate, request, upload, or distribute using our services.
• No Endorsement: Druid Cat does not endorse, verify, or take responsibility for the accuracy, legality, or appropriateness of any AI-generated content.
• Output Variability: AI models produce outputs based on probabilistic algorithms. Results may vary and may not always meet user expectations.
• No Guarantee: We do not guarantee that AI-generated content will be suitable for any particular purpose, free from errors, or legally compliant in any jurisdiction.

Prohibited Content

Users must not use our services to generate content that:

• Depicts minors in any inappropriate context
• Constitutes or promotes illegal activities
• Infringes on third-party intellectual property rights
• Contains defamatory, harassing, or threatening material
• Violates the terms of service of underlying AI providers
• Could be used for fraud, deception, or malicious purposes

Indemnification

Users agree to indemnify, defend, and hold harmless Druid Cat, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Content generated using our services
• Violation of these Terms & Conditions
• Violation of any third-party rights
• Any illegal or unauthorized use of our services

9. Limitation of Liability

Disclaimer of Warranties

To the maximum extent permitted by applicable law, Druid Cat expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties regarding the accuracy, reliability, or completeness of AI-generated outputs
• Warranties that services will be uninterrupted, secure, or error-free
• Warranties regarding third-party services, APIs, or infrastructure

What We're Not Liable For

• Content Quality: AI-generated content may not always meet expectations
• Commercial Success: No guarantee of commercial success using our tools
• Third-Party Services: Issues with external platforms, API providers, or infrastructure partners
• Data Loss: Always backup important generated content
• Indirect Damages: Lost profits, business interruption, loss of data, or consequential damages
• AI Model Behavior: Unexpected or undesirable outputs from AI models
• Service Interruptions: Downtime caused by third-party providers or circumstances beyond our control

Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRUID CAT'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO DRUID CAT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100 USD).
